About this agreement
MyAIVoiceAgent is operated by Legacy AI LLC Company Limited, a company registered in Hong Kong at Room 1701, 17/F, Wai Fung Plaza, 664 Nathan Road, Mong Kok, Kowloon, Hong Kong (“we”, “us”). This User Agreement covers the MyAIVoiceAgent website, the waitlist, and the MyAIVoiceAgent service: the AI voice agents, the app you manage them in, and the phone numbers and add-ons that come with them.
By creating an account, subscribing to a plan, joining the waitlist or using the site, you agree to these terms. If you accept them for a business, you confirm you're authorised to bind that business, and “you” means the business.
The service is for businesses. It isn't sold to consumers for personal use.
Accounts
You must be at least 18 and give accurate details when you sign up. You're responsible for keeping your login secure and for what happens under your account, including anything done by people you invite to a business.
Each business in the app has one owner. The owner is the billing contact, and their plan covers every business they own.
Plans
The plans, their prices and what each includes are listed on our pricing page. Every plan answers calls 24/7. Higher plans add features and more voice agents.
- Voice agents. Each plan includes a set number of voice agents: one on Starter, up to three on Pro and up to ten on Office. The count covers every agent across every business you own, including agents that are still being set up. You can add more with the extra voice agent add-on.
- Minutes. Each plan has a published monthly allowance of call minutes, shared across your whole account. Extra voice agents share the same allowance. We don't charge for going over it. If you regularly use more than your allowance, we'll contact you about moving to a plan that fits, and we won't send you a bill you didn't agree to. If your use stays well above the allowance and you choose not to move, we may end your plan at the end of your 12-month term instead of renewing it.
- Features marked “coming soon” aren't available yet. We'll add them when they're ready, but a feature marked this way isn't something you're buying today.
- Custom and agency arrangements are agreed separately in writing. Where that agreement conflicts with these terms, it takes priority.
Your 12-month term and how you pay
Every plan is a 12-month commitment that starts on the day your subscription begins. There is no setup fee and no free trial. You choose how to pay:
- Monthly: charged every month for the 12 months.
- Annually: the full year charged up front, at the discounted annual price (two months free).
Your plan renews automatically at the end of the 12 months unless you cancel before then:
- Monthly: the plan continues month to month at the monthly price. You can cancel at any time, and the cancellation takes effect at the end of the month you've already paid for.
- Annually: the plan renews for another 12 months and we charge the annual price on the renewal date. To stop it, cancel before that date. A renewal year isn't refunded once it has started.
We'll email the account owner at least 30 days before the first 12 months end, with the renewal date, the price and how to cancel. To cancel, email support@myaivoiceagent.ai.
Cancelling in the first 90 days
If you pay monthly and the service isn't working for you, you can cancel for any reason within 90 days of your subscription starting. Cancel on the Billing page in the app, or email support@myaivoiceagent.ai.
- Monthly: nothing more is charged after you cancel, and your plan keeps working to the end of the month you've already paid for. Months already paid for aren't refunded.
- Annually: a plan paid for the year up front can't be cancelled before that year is complete, and the year isn't refunded.
If you don't cancel within those 90 days, a monthly plan is committed to the rest of the 12 months and can no longer be cancelled on the Billing page. To ask about cancelling after day 90, contact support@myaivoiceagent.ai. If you stop the service early, the remaining monthly payments for the term are still due.
The $99 first month
Some new customers on the Pro plan paid monthly may be offered a $99 first month by one of our partners. You pay $99 for the first 30 days. On day 30 we charge the rest of the first month and the next month together on the card you used at sign-up. If you cancel before day 30, nothing more is charged. If the day-30 payment does not go through, the service is paused until it is paid. Everything else in this agreement still applies, including the 12-month term and the first 90 days cancellation window for monthly plans.
Add-ons
Add-ons are optional extras listed on the pricing page, such as extra voice agents, extra CRM connections and done-for-you call forwarding setup. A monthly add-on is charged alongside your plan and runs until you remove it. A one-time add-on is charged once, when you order it. Removing a monthly add-on takes effect at the end of the current billing month.
Phone numbers
- Your own number: you can keep your existing number and forward calls to your agent, or connect a number from your own phone provider account, at no extra charge from us. Your provider may still charge you for its own services.
- A number from us: we can provide a local number as a paid monthly add-on, at the price on the pricing page. The number is provided for use with the service. If your subscription ends or you remove the add-on, the number is released and may be reassigned. If you want to keep it, ask us before cancelling and we'll help you transfer it where the carrier allows.
Call forwarding is set on your phone line, so it depends on your phone provider. We can't answer a call that is never forwarded to us, for example because forwarding was switched off or set up incorrectly.
Payment
Prices are in US dollars and exclude any taxes, which are added where they apply. Payments are taken by card or another method our payment processor supports, and you authorise us to charge it for your plan and add-ons. We don't store full card numbers.
If a payment fails, we'll retry it and let you know. The service keeps running for at least 7 days after the first failed payment. If payment still hasn't been made by then, we may suspend the service until it is. Suspension doesn't cancel your plan or the amounts due under it.
If a charge looks wrong. Contact us before you dispute a charge with your card provider, and give us 10 business days to put it right. Most billing problems are fixed faster that way. If you dispute a charge that was correctly made, we may suspend the service while the dispute is open.
Price changes. Your price is fixed for your 12-month term. We may change prices after that, and we'll give you at least 30 days' notice before a new price applies to you. There are no discounts beyond those published on the pricing page.
Upgrades. You can move to a higher plan at any time. The higher price applies from the start of your next billing period. Moving to a lower plan is possible at the end of your 12-month term.
Your responsibilities
You're responsible for:
- The information you give your agent, including your website, documents, business hours and instructions. The agent answers from what you give it, so keep it accurate and up to date.
- Following the laws that apply to your calls. Your agent gives callers the notice described under “Telling callers” below. If the law where you or your callers are requires anything more, such as a notice on your own phone menu or website, that is yours to add.
- Having the right to use the content you upload and the phone numbers you connect.
- Reviewing the messages and leads your agent collects, and following up on them.
Not for emergencies. The service isn't an emergency service and isn't designed to handle emergency calls. Tell callers to contact the emergency services directly in an emergency.
Telling callers it's an AI and that the call is recorded
At the start of every call, your agent tells the caller that the call is answered by an AI assistant and may be recorded. We make and keep a written transcript of each call, and several US states require everyone on a call to agree before it is recorded. A caller who stays on the line after hearing the notice has been told.
This notice is part of the service on every plan. You can't switch it off, shorten it or ask us to remove it, and you agree not to work around it, for example by instructing your agent to say otherwise. Your agent also confirms it's an AI whenever a caller asks.
Health and other sensitive information
The service isn't built for regulated or highly sensitive information, and you agree not to use it to collect or store it:
- Health information covered by HIPAA. We don't sign business associate agreements, so the service must not be used to create, receive or keep protected health information. A clinic can use an agent to answer the phone, give opening hours and book a time, but must not have it take symptoms, diagnoses, treatment details or insurance information.
- Payment card details. Don't have your agent ask for or take card numbers, security codes or bank account details on a call.
- Government ID numbers, such as Social Security, passport or driver's licence numbers.
Callers sometimes volunteer things nobody asked for, and those words can end up in a transcript. Tell us and we'll delete the transcript. If you use the service for information this section rules out, the responsibility for that is yours.
What an AI agent can and can't do
Your agent uses speech recognition and AI language models. It can mishear a caller, misunderstand a request, or give an answer that is incomplete or wrong, even when it has accurate information.
We work to make it reliable, but we don't guarantee that every call will be answered, understood or handled correctly, or that the service will bring you a particular number of bookings, leads or revenue. Calls can also fail because of the phone network or the providers we rely on.
Acceptable use
You agree not to:
- Use the service for anything unlawful, fraudulent, deceptive or harassing.
- Make the agent impersonate a real person, or tell callers it's a human.
- Use the service for unsolicited calls or messages, or to collect information from callers without a lawful basis.
- Upload content that infringes someone else's rights or contains malware.
- Interfere with the service, test its security without permission, attempt unauthorised access, or use automated tools to overload it.
- Resell or white-label the service without a separate agency agreement with us.
- Submit false information or impersonate another person or business.
Your data
You own your business information and the content you upload. Your callers' information, including call transcripts, messages and leads, is processed on your behalf. We use it to run the service for you, to keep it secure, and to fix and improve it. We don't sell it and don't use it to train AI models. Our Privacy Policy explains how we handle personal information, including which providers process it.
You give us permission to host, copy and process your content as needed to provide the service, including reading your website and documents so your agent can answer from them.
Our service and brand
The service, software, website, design, characters, logos and related materials belong to Legacy AI LLC Company Limited or its licensors. You may use the service for your business during your subscription, but you may not copy, reverse engineer, resell or build a competing product from it. If you send us feedback, we may use it without any obligation to you.
Third-party services
The service relies on third-party providers for hosting, telephony, speech and AI. It can also connect to services you use, such as your own phone provider. We aren't responsible for third-party services we don't control, and your use of your own accounts with them is governed by their terms.
Suspension and ending the service
We may suspend or end your access if you seriously or repeatedly break these terms, if payment is overdue as described above, or if we need to in order to prevent harm or comply with the law. Where we reasonably can, we'll warn you first and give you a chance to fix the problem.
When your service ends, your agents stop answering calls. You can ask us for a copy of your call transcripts, messages and leads within 30 days. After that, we delete your data as described in the Privacy Policy.
The waitlist
Joining the waitlist doesn't guarantee access, launch timing, availability, pricing, a position in line, or acceptance as a customer. We may change, pause or close the waitlist at any time.
Disclaimers
Apart from what these terms expressly say, the site and service are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all other warranties, including that the service will be uninterrupted, error-free or fit for a particular purpose. Nothing the site or your agent says is legal, financial, medical or other professional advice.
Liability
To the fullest extent permitted by law, neither of us will be liable to the other for indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data or business opportunity, including calls or bookings that were missed or handled incorrectly.
Our total liability arising from the service in any 12-month period is limited to the amount you paid us for the service in that period. If you only use the free website or waitlist, it is limited to USD 100.
These limits don't apply to your payment obligations, or where liability cannot lawfully be excluded or limited.
You'll cover our reasonable losses and costs from a claim by a third party that arises from your content, your calls, or your breach of these terms or the law.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.
If something goes wrong, email us first. We'll both try in good faith to settle it within 30 days. A dispute that isn't settled that way will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, in English. The hearing takes place by video or phone unless we both agree to meet in person, and the legal seat of the arbitration is Wilmington, Delaware. Judgment on the award may be entered in any court that has jurisdiction.
Disputes are brought one at a time, between you and us only. Neither of us may bring a claim as part of a class or representative action. Either of us may still use a small claims court for a claim that qualifies, or ask a court for an order to stop misuse of its intellectual property or confidential information. Nothing here removes a right the law in your location says can't be waived.
Changes and contact
We may update these terms. The effective date at the top shows the latest revision. If a change materially affects paying customers, we'll give you at least 30 days' notice by email or in the app. Changes to price follow the price change rule above.
Your way out. If we change these terms in a way that is materially worse for you, or remove a feature of your plan that you rely on, you can cancel within 30 days of our notice, even in the middle of your 12-month term. Nothing further is owed for the rest of the term, and if you paid annually we refund the months you haven't used. A feature marked “coming soon” that arrives late or changes before it ships doesn't count as one removed.
